EXPLANATION OF NAWAS AND THESE TERMS AND CONDITIONS: Nawas International Travel Service, Inc. is a tour operator that functions on an ad-hoc/custom basis. As such, tour-specific information such as dates of exchange rates, airfares and airline surcharges, dates of air and local taxes, specific details for customized tours, accommodation types, minimum group size and other details may be tour-specific and are stated directly in the tour brochure in the “Tour Specific Information” section of the tour brochure. Please refer to the “Tour Specific Information” section of the tour brochure for this tour-specific information. For all such tour-specific information, these details are made a part of your agreement with us and with these terms and conditions. We recommend that you keep copies of these documents for your own records. Should you require a copy of this information after reservation, please contact us.

TOURS TO ITALY IN 2025: Please note that these Terms and Conditions DO NOT apply to tours traveling to Italy between Dec 20, 2024 and January 7, 2026 as well as tours which include travel to other countries along with Italy. For the information related to the applicable Terms and Conditions for tours to Italy including tours that travel to other countries along with Italy, please refer to your Italy 2025 tour brochure.

AGREEMENT TO BE BOUND: By booking your travel arrangements with us, you are agreeing to be bound by the terms and conditions together with any additional documentation we give you (“The Agreement”) and any additional terms and conditions of any Supplier that are applicable to your travel arrangement. The Agreement describes what you are legally entitled to expect from us when you book your trip through us, in addition to important obligations you enter into as a traveler that significantly affect your legal rights. Therefore, it is of vital importance that you read the terms and conditions in their entirety. The lead guest assumes the responsibility of sharing these Terms and Conditions with each guest for whom they make a booking. NAWAS is not responsible for any guest’s unawareness of the Terms and Conditions due to the failure of the lead guest to share this information with all other guests in their group.

The terms “we”, “us” and “our”, and “NAWAS” refer to Nawas International Travel Service, Inc. The term “Tour Leader” refers to tour leaders, hosts, organizers, and other entities that are involved in sponsoring, hosting, and/or promoting the tour. The term “you” and “guest” refers to the customer visiting our website, and/or booking a reservation with us.

RESERVATIONS, DEPOSITS & FINAL PAYMENT: We look forward to booking your travel. You may contact us at one of our three offices to book your travel. The appropriate number is located on the brochure. After booking, if you have questions or concerns, we welcome your calls, but we ask that you call the same office as they will have all of your pertinent information and will therefore best be in a position to assist you.

Planning travel takes time and effort and many costs are incurred before you ever depart, therefore, reservations may be secured upon payment of a deposit. Please refer to the below destination payment terms.

Europe (excluding tours to Italy as well as tours that travel to other countries along with Italy)

  • A $500 deposit is due with your reservation
  • Final payment is due at NAWAS 100 days prior to departure date

Israel, Jordan, and Greece/Turkey Land Tours

  • A $500 deposit is due with your reservation
  • Final payment is due at NAWAS 100 days prior to departure date

Greece/Turkey Tours that Include a Cruise

  • A $600 deposit is due with your reservation
  • Final payment is due at NAWAS 110 days prior to departure date

Egypt and Nile Cruise

  • A $800 deposit is due with your reservation
  • Final payment is due at NAWAS 110 days prior to departure date

Ocean & Sea Cruises

  • A $800 deposit is due with your reservation
  • Final payment is due at NAWAS 125 days prior to departure date

Amadeus River Cruises

  • Deposit deadline – A $800 deposit is due with your reservation. The deadline to submit your initial deposit is 190 days prior to departure.
  • Final payment – Final payment is due at NAWAS 140 days prior to departure date.

Custom Tours

  • Custom Tours have different payment terms. For Custom Tours, please refer to the brochure materials for payment terms. If your tour is a Custom Tour, the payment terms are indicated in the “Tour Specific Information” section of the tour brochure. For all such Custom Tours, the brochure payment dates, as indicated in the “Tour Specific Information” section of the tour brochure are hereby made a part of your agreement with us and with these Terms and Conditions.

No reservation is considered firm until deposit has been received by NAWAS. Your initial deposit payment shall be deemed to be an acceptance of this Booking Agreement and Terms and Conditions for yourself and all members of your party or group. Space is limited and offered on a first-come basis. Any failure to make timely payments may result in cancellation of your tour at the sole discretion of NAWAS. In such case our cancellation policy would apply.

NAWAS accepts Visa and Mastercard for balance/final payments only. Credit cards are not accepted for deposits. The price of the tour already includes a built-in discount of 4% for payments made by cash or check. There is no discount on credit card sales. Credit cards will only be accepted prior to the final payment due date. Credit card charges cannot be accepted over the telephone. Guests who want to use a credit card for final payment should contact NAWAS before the final payment is due for further information.

While we do accept Visa and Mastercard, you must provide to us a signed charge authorization agreement or click authorization for every transaction for your trip. Your authorization is a binding agreement for us to charge your card and as such you waive any right to chargeback in the case of cancellation for any cause whatsoever, including a Force Majeure event, as defined herein, and agree to refund policies and procedures as outlined in these Terms and Conditions. In the event a guest attempts to chargeback, reverse, or recollect a trip payment already made without the authorization of NAWAS, we reserve the right to collect all additional costs, fees and expenses associated with such chargeback, reversal or recollection, including trip planning fee, without limitation, and attorney fees.

TRAVEL DOCUMENTS: A U.S.A. passport valid for 6 months after the return date of the trip is required to travel. It is the sole responsibility of the guest to check their passport’s expiration date. Some countries require a full blank page in the passport for stamping purposes. Both U.S.A. citizens and Non-U.S.A. citizens may require visas and/or transit visas in addition to a valid passport. It is the sole responsibility of U.S.A. citizens and non-U.S.A. citizens (including green card holders) to ensure they have the required visas/transit visas/travel documents for each country they will travel through or visit on their tour and for re-entry into the U.S.A. Visa fees (if any and of all types) are not included in the tour price. The possession of required and valid passport and visas is the sole responsibility of the guest. NAWAS assumes no liability for lack of proper documents, and cancellation policies remain in full effect. Please note that entry to any country may be refused even if the required information and travel documents are complete. Nawas is not liable for denied boarding.

Entry to the European Union and the United Kingdom: Starting in early 2025, the European Union (EU) will require travelers who do not hold an EU passport to apply for an Electronic Authorization (ETIAS) prior to travel to the EU and the Schengen Area. The United Kingdom (UK) has also implemented an Electronic Travel Authorization system (ETA) for entry into the UK (England, Wales, Scotland and Northern Ireland). The new requirements apply to American citizens and others. It is the responsibility of every traveler to apply for the required Electronic Authorization prior to their departure.

It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc. We recommend that you keep a copy of your scanned passport (photograph page) on your email while traveling.

Any failure of a guest to have proper visas and/or passport will likely result in the guest not being able to leave the country or enter a destination and no refund will be available in any such case and NAWAS will have no liability in such case.

CHILDREN: All children under 18 must be accompanied by an adult. Acceptance of children on the tour is at the sole discretion of NAWAS and we reserve the right to accept or reject children’s participation on the tour at any time and for any reason. Accompanying adults are responsible for children and for their safety, including to provide any necessary safety equipment. If you are traveling with children, you are solely responsible for their behavior and monitoring them throughout the tour. Please note that many countries have adopted practices to prevent international abductions of children. If a person under the age of 18 years will be travelling with an adult other than his/her parents, or with only one parent, a notarized letter written by the parents, or non-travelling parent, granting authorization to travel, including the dates of travel and locations of travel should be carried.

AIR TRANSPORTATION: The Tour Price includes Air transportation by any IATA/ARC air carrier or other scheduled jet carrier in standard economy class. Flights and air routings are at the discretion of air carriers and are subject to change without notice. Air arrangements are based on non-refundable bulk group-airfares and cannot be upgraded to Premium Economy, Business or First Class. Airlines require a minimum of 14 persons departing from the same gateway city and returning together on the same date. Cancellations made after air tickets have been issued are subject to full cancellation penalties as imposed by the airlines. Per TSA regulations, airline tickets must bear your first, middle, and last name as it appears on your passport and guests are responsible to bear any name-change fees should they not provide NAWAS with accurate passport information 90 days prior to departure.

Airfare purchased by NAWAS is subject to each airline’s passage contract and terms and conditions. Once air tickets are issued, the passage contract in use by the airlines concerned shall constitute the sole contract between the airlines and the guest. Airfare rules will apply to tours cancelled for any reason. Non-refundable bulk group air arrangements are subject to increased restrictions imposed by the airlines. Schedules, routings, connections, and connection times are at the sole discretion of the airline and NAWAS bears no responsibility and has no control over this. At times, airlines may cancel flights requiring the group to be re-booked on an alternative airline and/or schedule that may be less favorable than the original, shorten or lengthen connection times, or change routings which may inconvenience the passenger and for which NAWAS has no control. Due to increased security measures at airports, there may be a considerable amount of time required to pass through security and customs checkpoints on arrival, departure, and in-between connections. Different airports and countries have different security procedures and you may be subjected to increased security measures such as search of your baggage or person, questioning, and other measures as these security agents deem necessary. NAWAS has no control over government security measures and no control over airline and airport connection times. Due to the outbreak of Covid-19, governments and airlines have imposed policies requiring guests to adhere to safety and health standards, which may require the use of Personal Protective Equipment, Covid-19 testing, and health documentation/inoculation/vaccination records in order to travel to your destination. It is the sole responsibility of the guest to keep up-to-date with the most recent requirements and to adhere to all of these requirements and NAWAS has no liability or responsibility for the failure of the guest to comply with these government and airline requirements.

AIRLINE SEATING: NAWAS contracts non-refundable bulk group airfares in standard economy class. Airlines no longer provide seat assignments for groups and Nawas does not guarantee specific seat assignments. Seat assignments for groups are made at the discretion of the airline and are typically allocated by automated airline computer systems in alphabetical order. Seat assignments will not be advised until check in at the airport. NAWAS cannot request and does not guarantee specific seat assignments.

AIRLINE FREQUENT FLYER PROGRAMS: Guests are responsible to contact their airline directly regarding mileage eligibility and accrual. Airline frequent flier programs determine whether to award miles in part, in total, or not at all based on their own rules which are updated frequently. Some airfares, such as non-refundable bulk group airfares, may not be eligible for mileage accrual and this is entirely determined by the airline and NAWAS has no control. Airline schedule changes may result in flights which were originally eligible for mileage accrual no longer being eligible. We highly recommend guests to provide their frequent flier account information whenever checking in for their flights. After travel has commenced, it is often not possible to apply for mileage credit. Mileage may not be used to secure discounts or upgrades with airfare booked by NAWAS. We recommend that you retain your passenger ticket receipt as well as boarding passes for your records. Nawas is not able to provide you with copies of these documents.

TAXES/AIRLINE SURCHARGES: U.S. departure taxes, overseas airport taxes, overseas local government taxes, airline security fees and airline imposed international surcharges are included in your tour price and are based on the given rate of a specific date as indicated in the “Tour Specific Information” section of the tour brochure. Hotel tourist taxes, if any, are not included in the tour price. Please refer to the “Tour Specific Information” section of the tour brochure for this date information as this varies from tour to tour. Future price increases may be applied due to additional costs as imposed by a supplier or governments.

SURFACE TRANSPORTATION: Transportation by motorcoach, bus, minibus, van, motor car, automobile, train, trolley, or any other means of conveyance as deemed appropriate by NAWAS are included in your tour price.

HOTEL ACCOMMODATIONS: Accommodation is included in the tour price and the type and quality vary by tour program. Please refer to your tour brochure for this information. Room selection in all cases is strictly at the discretion of the hotel’s management on a run-of-house basis. NAWAS cannot guarantee roommates. A guest taking a single room, subject to availability, must pay a single room supplement. Please refer to your tour brochure for single room supplement costs. Single rooms are limited in availability and may be small. Triple rooms are subject to availability and many hotels do not offer triple rooms. Where available, triple rooms consist of any combination of standard twin beds, double bed, sofa/folding bed, or cot. There is no price reduction for passengers in a triple room. The number of persons accommodated does not dictate the room size. Although available at most hotels, use of air-conditioning abroad differs greatly from the United States and in some cases may not be available. Many hotels were built before central air-conditioning was introduced. Air conditioning is often shut down at night and from the end until the start of the summer months. Certain countries may have environmental laws and regulations that require that A/C be turned off at certain times of day or during certain seasons. For safety reasons, windows may not be able to be fully opened. Complaints regarding a hotel’s standard or amenities should be addressed directly with the hotel’s management. Issues and complaints are more likely to be resolved if brought up locally on-the-spot to the hotel management, your tour director, or guide. Hotels often will not consider complaints if they were not given the opportunity to address those complaints locally on-the-spot.

While we exercise due diligence in the selection of our partners, hotel and other accommodation profiles are based on information provided to us by the supplier. This includes images and descriptions of the properties and rooms. Additionally, guests should be aware that star ratings or similar systems are based on country classifications and therefore can differ. While NAWAS does its best to maintain current and accurate information regarding these suppliers, we cannot be held responsible for any inaccuracies in supplier descriptions, amenities, or images.

MEALS: Meals specified in each itinerary are included in your tour price. Meals are based on the hotel’s or restaurant’s buffet or set menu. In general, beverages are not included, unless specifically stated. Dietary requests should be provided at the time of booking and no later than 130 days prior to departure. Although NAWAS cannot make any guarantees, we will make every effort to honor your dietary requests. Dietary standards and terminology vary greatly from country to country and it is the sole responsibility of the passenger to ensure that all food and beverage contents provided to them and consumed by them meet their dietary needs. NAWAS has no liability or responsibility for the guest’s failure to ensure that food and beverage contents meet their dietary needs or for the failure of the supplier of the food and/or beverage to adhere to the guest’s requests.

SIGHTSEEING: As specified in the itinerary using motorcoach transportation or other conveyances as required. Entrance fees and the services of English-speaking guides are only included if specified in the itinerary. Nawas offers Spanish-speaking tour services to its customers on an ad hoc/custom basis. If your tour is offered with Spanish-speaking services it will be stated in the brochure materials, and in this case, your tour will include Spanish-speaking guide services. As a courtesy to others in the tour, it is mandatory that you be on time for all scheduled experiences. Tours will begin on-time and failure to arrive will be considered a no-show for which no refunds will be available. It is essential that you keep in mind that tour times are set to accommodate climate, crowd size and best viewing options for our groups. At times, early morning departure times may help create a better experience. Therefore, late arrivals cannot be accommodated and will be left behind and it will be the sole responsibility of the guest to bear any necessary expenses to rejoin the group. Group sizes may vary from day to day.

Itinerary language and order are descriptive and may not represent the actual order of sightseeing that you experience while on tour. Though every effort will be made to follow the itinerary, it should be considered as an indication of the tour, rather than a contract of places to be visited.

OPTIONALS/ALTERNATE ACTIVITIES: If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement. In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage or loss will be against the supplier of the alternate activity.

From time to time while on tour, you may be offered an optional excursion that is not included in your tour program. These optional excursions are not provided by NAWAS and are provided by independent third-party operators (“Excursion Operators”), including but not limited to, your tour director, guide, motorcoach operator, cruise personnel, affiliated companies or others. NAWAS does not endorse these optional excursions and has no involvement in this. By engaging in an optional excursion offered by an Excursion Operator you release, indemnify, and hold harmless Nawas International Travel Service, Inc. and our affiliated companies from any and all claims, damages, losses, and liability arising out of the optional excursion.

TRANSFERS: Assistance and transfers for groups of 15 or more travelers from airports to hotels and vice versa via motorcoach or other means of conveyance are included in your tour if you have purchased the group-air inclusive tour package. Groups of fewer than 15 are responsible for their own transfers.

SERVICE CHARGES/TAXES/PORTERAGE: Service charges and taxes normally included in bills, government taxes on hotel bills (excluding hotel tourist taxes), taxes on sightseeing and excursions trips and porterage at hotels of one normal size suitcase, where available, are included in the tour price based on the given rate of a specific date as indicated in the “Tour Specific Information” section of the tour brochure. Please refer to the “Tour Specific Information” section of the tour brochure for this date information as this varies from tour to tour. Porterage may not be available at select locations or airports.

LAND ONLY ARRANGEMENTS: All land only requests must be received by NAWAS in writing no later than 130 days prior to departure. Land only arrangements (tour package excluding air transportation) are provided as a courtesy for the customer (our tours are group-air inclusive). Land only arrangements may be subject to availability and on certain tours land only arrangements may not be permitted and this is at the sole discretion of NAWAS. Please inquire with us about land only availability on your tour. If you purchase a land only package, you must provide to us a signed land only agreement and you acknowledge that by purchasing a land only package you are responsible for your own air arrangements and for your own transfers from airports to hotels and vice-versa. We recommend that you do not make your arrangements until all of the group arrangements have been finalized and that you inquire with us to determine the group’s status before making any independent air arrangements. NAWAS is in no way responsible or liable for arrangements that you independently make.

DEVIATIONS: All deviation requests from the tour’s group flight arrangements must be received by NAWAS in writing no later than 130 days prior to departure. Air deviations are subject to availability and restrictions as imposed by the airline. Air deviations are only possible on the return portion of the flight schedule, and furthermore, are not available on some tours and on certain airlines. Air deviations do not permit a change of gateway from the originally scheduled arrangement. Air deviations may not be permitted and this is at the sole discretion of NAWAS. For air deviations, a $100 non-refundable fee per person will be charged in addition to any extra airfare that the airlines may charge. No refunds can be offered for deviations from the tour’s scheduled itinerary or for any unused services.

BAGGAGE: Airlines may now charge baggage fees for checked luggage on international/ domestic flights based on the policy of each carrier. The maximum number of pieces of luggage, the weight allowance and baggage dimensions may also vary by airline and destination. Many carriers require that checked luggage in economy class not exceed 50 pounds with a combined length, width and height of 62 inches. Regulations vary for business/first class passengers. Airline policies regarding baggage are subject to change at any time without notice and are at the sole-discretion of the airlines. It is the responsibility of each guest to check with their airlines prior to departure for baggage information, regulations and compliance. Please refer to your electronic airline ticket receipt once received with the final tour documents. NAWAS is not responsible for fees imposed by air carriers regarding baggage and, if applicable, these fees are not included in your tour price. Due to space limitations on NAWAS motorcoaches, NAWAS can only allow one piece of luggage per guest plus a motorcoach carry-on bag with dimensions of 12”x11”x6” inches maximum which must fit in the overhead bin or underneath the seat in front of you. For safety reasons and due to limited capacity, wheeled carry-on bags are not permitted. Keep an eye on your baggage – it is your responsibility throughout the trip. NAWAS is not responsible for loss, theft, or damage to baggage and/or personal belongings at any time during the tour, or on included transfers and other transportation. Travel protection plans may offer coverage for delayed, lost or damaged baggage.

TRAVELERS REQUIRING SPECIAL ASSISTANCE: Disabled guests requiring special attention or care must advise NAWAS in writing at the time of reservation. A physically able companion must accompany any person who needs special assistance. Tour directors, guides, drivers or other tour, hotel or ship personnel are not able to provide such assistance. NAWAS is not responsible for any denial of services to the disabled guest by air carriers, cruise ships, hotels, restaurants or other independent suppliers. Certain countries/destinations involve extensive walking. Be aware that outside the U.S. the Americans with Disabilities Act is not applicable and facilities for disabled individuals are limited. NAWAS is not responsible for any guest requiring special medical equipment. NAWAS reserves the right to reject participation or remove any individual from a tour in the event that notification was not provided and/or when, in our sole judgement, continued participation would significantly hinder the services to be provided to all guests. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the responsibility of the passenger. Clients with special needs may be better served independently.

SUITABILITY & ACCESSIBILITY: Certain activities or venues may be limited or inaccessible to you if your mobility is limited in any manner. Many excursions and sightseeing involve extended periods of walking and standing often on uneven pavement or surfaces, and may include staircases, paths, walkways, or locations that are narrow or inaccessible or of limited accessibility. You are responsible for assessing if the itinerary is suitable for all guests on the reservation. No refunds are provided for missed services or activities due to your inability to fully participate with the group, including keeping pace with the group.

PETS: Pets are not permitted on NAWAS tours.

THE TOUR PRICE DOES NOT INCLUDE:
Passport fees, visa fees (if any), transit visa fees (if any), hotel tourist taxes (to be paid locally), phone calls, valet/laundry service, wines, liquors, mineral water, after dinner coffee or tea, tips to tour directors, tour escorts, local guides, drivers and waiters, sightseeing and other services not specifically mentioned, excess baggage and all other items of a purely personal nature. This list is illustrative and not a complete list of every item not included.

GUEST CANCELLATIONS: In order to cancel your reservation, you must notify NAWAS in writing. Calculation of cancellation amounts are based on the number of days prior to departure by which we receive the notification in writing. It will be effective on the date of receipt if received during normal business hours. Cancellations received after normal business hours or on weekends or holidays will be considered received on the next business day. See the below terms for cancellation charges.

Europe (excluding tours to Italy as well as tours that travel to other countries along with Italy)

  • Up to 100 days prior to departure, refunds will be made less a $200 per person fee.
  • From 99 to 70 days prior to departure, refunds will be made less a $500 per person fee.
  • From 69 to 35 days prior to departure, refunds will be made less a fee of 50% of the total tour price per person.
  • From 34 days up to and including the day of departure, reservations are subject to a 100% cancellation fee.

Israel, Jordan, and Greece/Turkey Land Tours

  • Up to 121 days prior to departure, refunds will be made less a $200 per person fee.
  • From 120 to 91 days prior to departure, refunds will be made less a $500 per person fee.
  • From 90 to 41 days prior to departure, refunds will be made less a fee of 50% of the total tour price per person.
  • From 40 days up to and including the day of departure, reservations are subject to a 100% cancellation fee.

Greece/Turkey Tours that Include a Cruise

  • Up to 125 days prior to departure, refunds will be made less a $300 per person fee.
  • From 124 to 91 days prior to departure, refunds will be made less a $600 per person fee.
  • From 90 to 41 days prior to departure, refunds will be made less a fee of 50% of the total tour price per person.
  • From 40 days up to and including the day of departure, reservations are subject to a 100% cancellation fee.

Egypt and Nile Cruise

  • Up to 125 days prior to departure, refunds will be made less a $400 per person fee.
  • From 124 days to 91 days prior to departure, refunds will be made less an $800 per person fee.
  • From 90 to 41 days prior to departure, refunds will be made less a fee of 50% of the total tour price per person.
  • From 40 days up to and including the day of departure, reservations are subject to a 100% cancellation fee.

Ocean & Sea Cruises

  • Up to 125 days prior to departure, refunds will be made less a $400 per person fee.
  • From 124 to 95 days prior to departure, refunds will be made less a $800 per person fee.
  • From 94 to 81 days prior to departure, refunds will be made less a fee of 35% of the total tour price per person.
  • From 80 to 65 days prior to departure, refunds will be made less a fee of 50% of the total tour price per person.
  • From 64 to 40 days prior to departure, refunds will be made less a fee of 75% of the total tour price per person.
  • From 39 days up to and including the day of departure, reservations are subject to a 100% cancellation fee.

Amadeus River Cruises

  • Up to 190 days prior to departure, refunds will be made less a $500 per person fee.
  • From 189 to 140 days prior to departure, refunds will be made less a $800 per person fee.
  • From 139 to 100 days prior to departure, refunds will be made less a fee of 50% of the total tour price per person.
  • From 99 to 70 days prior to departure, refunds will be made less a fee of 80% of the total tour price per person.

Custom Tours

  • Custom Tours have different cancellation terms. For Custom Tours, please refer to the brochure materials for cancellation terms. If your tour is a Custom Tour, the cancellation terms are indicated in the “Tour Specific Information” section of the tour brochure. For all such Custom Tours, the brochure cancellation terms, as indicated in the “Tour Specific Information” section of the tour brochure are hereby made a part of your agreement with us and with these Terms and Conditions.

NAWAS reserves the right to cancel your tour reservation and retain your deposit if final payment is not received by the due date. Airline tickets are not refundable once issued. No refunds will be given for any unused services while on tour. No Shows are subject to a 100% cancellation fee and their reservation will be cancelled.

AMADEUS RIVER CRUISES – LACK OF PARTICIPATION & OVERBOOKINGS: Nawas works in partnership with Amadeus River Cruises, LLC. NAWAS makes no guarantee of cabin availability or shore excursion availability on any sailing offered in partnership with Amadeus River Cruises, LLC. From time to time, a sailing or shore excursion may be cancelled due to lack of participation or may become overbooked. You agree that we retain the right to overbook guest accommodation and shore excursions. In the event of the aforementioned situation of lack of participation or overbooking, we may at our discretion, deny boarding to any guest, and at our further discretion, refund monies paid or offer another tour in substitution. We may offer alternative tour dates or other travel arrangements, but there is no guarantee of availability. You may choose to accept these arrangements and NAWAS will refund the difference in price if the alternate is lower. You are responsible for additional costs if you select an alternate that is higher. If this rebooking option is not acceptable to you or in the case where alternatives are not offered, the only responsibility of NAWAS is to refund the amounts paid by you for the reservation, except in the case of Force Majeure, as described herein. Any air cancellation will be in accordance with the terms of the carrier and NAWAS will not be liable for the carrier’s refusal to make any refund whatsoever. In such case, NAWAS will not be liable for any additional costs incurred outside of the tour prices such as visa and passport fees, travel insurance, air tickets or other travel arrangements not made by us, or any other purchases made by the guest in anticipation of the tour.

AMADEUS RIVER CRUISES – CHANGES IN THE WATER LEVEL: Unusually low or high river water levels may cause changes to the itinerary, possible re-embarkation on another vessel or transfer(s) by coach or rail, or even to a shortening of the journey. NAWAS has no involvement in such decisions and all decisions are solely made by Amadeus River Cruises, LLC., the ship operator Danubia Kreuzfahrten GmbH / Vienna-Austria, and the ship’s captain. Amadeus River Cruises, the ship operator Danubia Kreuzfahrten GmbH / Vienna-Austria, and the ship’s captain sometimes have to take such decisions quickly. Such measures may not, understandably enough, justify cancellation termination or withdrawal from the contract by the person travelling; and passengers may not derive from them any claims on NAWAS or Amadeus, including without limitation claims for monetary damages. In the event that the cruise is interrupted or cut short due to changes in the water level, all expenses for alternative travel arrangements, including but not limited to transportation, accommodation, and air travel will be the burden of the guest and NAWAS has no responsibility for any related expenses.

AMADEUS RIVER CRUISES – CHILDREN: Due to the nature of the cruise itineraries, Amadeus River Cruises does not maintain facilities or services for children aboard their cruise vessels. On all cruises and cruise journeys, minors under the age of 18 must be accompanied and share a cabin with a parent or legal guardian, or other responsible adult over the age of 21. Amadeus River cruises does not permit and does not accommodate children under the age of 12 years of age, and Amadeus River Cruises reserves the right to limit the number of minors under the age of 18 on board.

AMADEUS RIVER CRUISES – COVID-19 AND HEALTH PROTOCOLS: Amadeus River Cruises may institute health protocols, including but not limited to Covid-19, Influenza, Colds and Norovirus, for the safety of the guests on board the cruise vessel. You agree to accept these risks and to adhere to all protocols in place. Failure to comply with applicable cruise health protocols may result in your removal from the tour, you will be due no refund, and you will bear the burden of any related expenses, including for your own travel arrangements.

AMADEUS RIVER CRUISES – STOPOVER AND DISEMBARKATION: Unauthorized stopover or disembarkation or failure to make any sailing of the ship at any port shall be at your sole risk and expense, you may be denied subsequent boarding, and you will not be entitled to any refund, payment, compensation, or credit of any kind.

IMPORTANT NOTICE – TOUR PRICING: The airfare used is based on non-refundable bulk group fares based on the given rate of a specific date as indicated in the “Tour Specific Information” section of the tour brochure. Please refer to the “Tour Specific Information” section of the tour brochure for this date information as this varies from tour to tour. Airlines reserve the right to increase fares without prior notice. Guests will be required to pay any airfare increases and international surcharges as imposed by the airlines prior to departure.

Land costs are based on rates, tariffs, overseas government taxes, and rates of exchange in effect on a specific date as indicated in the “Tour Specific Information” section of the tour brochure. Please refer to the “Tour Specific Information” section of the tour brochure for this date information as this varies from tour to tour. While we have made the best possible estimates of what we expect future costs for your tour to be, we cannot guarantee actual prices, taxes, exchange rates, and airfares. Any increases in land costs or airfare that may occur will be collected from each guest prior to departure. We reserve the right to increase the cost of the tour consistent with normal increases should the group fall below the advertised minimum number of tour passengers (please refer to the “Tour Specific Information” section of the tour brochure for the minimum number of tour passengers as this varies from tour to tour), or in the event of fluctuations in exchange rates. All prices are based on given rate of exchange on a specific date as indicated in the “Tour Specific Information” section of the tour brochure. Please refer to the “Tour Specific Information” section of the tour brochure for this date information as it varies from tour to tour. While every effort will be made to hold them firm, prices are subject to change. You understand and acknowledge that the tour you are purchasing is subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. You acknowledge that you may be charged additional sums by NAWAS to offset increased fees, taxes, airline imposed international surcharges, fluctuations in exchange rates, the group falling below the advertised minimum tour participation, or any combination thereof along with any other items as stated in these Terms and Conditions. You hereby consent to any post-purchase price increases and authorize NAWAS to charge you for such additional amounts.

NON-OPERATION OF GROUP TOURS: All group tours are based on a minimum number of participants. This information may be found in the “Tour Specific Information” section of the tour brochure. NAWAS makes every effort to ensure that tours meet this requirement, but from time to time we may not have the sufficient participants required to operate a tour or because a tour is not operationally economical and the cancellation of the tour may occur at the sole discretion of NAWAS. In such case, guests will be advised at least 45 days prior to departure. NAWAS reserves the right to change the departure date. We may offer alternative tour dates or other travel arrangements, but there is no guarantee of availability. You may choose to accept these arrangements and NAWAS will refund the difference in price if the alternate is lower. You are responsible for additional costs if you select an alternate that is higher. If this rebooking option is not acceptable to you or in the case where alternatives are not offered, the only responsibility of NAWAS is to refund the amounts paid by you for the reservation, except in the case of Force Majeure, as described herein. Any air cancellation will be in accordance with the terms of the carrier and NAWAS will not be liable for the carrier’s refusal to make any refund whatsoever. In such case NAWAS will not be liable for any additional costs incurred outside of the tour prices such as visa and passport fees, travel insurance, air tickets or other travel arrangements not made by us, or any other purchases made by the guest in anticipation of the tour.

CANCELLATION BY NAWAS: We reserve the right to cancel or reschedule any departure, reservation, or travel arrangement for any reason, including your violation of any of these Terms and Conditions. If we cancel, except in the case of Force Majeure or Non-Operation of Group Tours, as described herein, we may offer alternate arrangements, but there is no guarantee of availability. We may at our sole discretion offer travel credit or refunds in accordance with the applicable Guest Cancellations schedule. Guest is responsible for any additional costs for air tickets or other travel arrangements not made by NAWAS. Guest’s cancelled for violation of any terms will not be entitled to any refund, credit, voucher or future travel.

FORCE MAJEURE: NAWAS assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, criminal activities, war, insurrection, nuclear events, event cancellations, event postponements, supplier bankruptcy or insolvency, default of a supplier in providing the agreed upon transportation or service, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by NAWAS that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the event that any of these conditions apply, NAWAS shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind including liability to make any refund. In the case of a force majeure event, NAWAS’ sole obligation will be to provide travel credits in the amount paid to NAWAS, and only to the extent NAWAS’ suppliers are crediting us with monies paid to them. The travel credit is applicable to a future Nawas tour. In no case will NAWAS be liable or responsible for a supplier’s bankruptcy, default or insolvency and in such case NAWAS will not be required to honor supplier credits. In any such case, you agree that NAWAS’ efforts with suppliers are made in good faith and in no case will NAWAS be required to proceed legally against any supplier.

TRAVEL PROTECTION PLAN: NAWAS strongly encourages all guests to purchase a Travel Protection Plan. Such plan at a minimum should cover Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss. Purchasing coverage may be limited by time constraints so it is imperative that you purchase protection as soon as possible after booking.

NAWAS is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel protection plans. NAWAS cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection, call your insurer or insurance agent or broker.

NAWAS recommends plans that include additional Cancel For Any Reason coverage, such coverage can be beneficial in protecting you in the event of the need for sudden cancellation that is not covered in traditional plans, and is a proactive step you can take to protect your investment. These plans do cost additional money and must be purchased relatively soon after booking. If you are interested in such additional coverage you should contact your insurance agent immediately.

Declining travel protection plan coverage could result in the loss of your travel cost and/or require more money to correct the situation. You acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.

Travel Protection Coverage for trip cancellation, medical evacuation, medical emergencies, baggage, etc. is available for purchase. A travel protection pamphlet will be sent upon written request. Please refer to the travel protection plan policy for complete details.

Please note that healthcare/medical costs outside the U.S.A. may not be covered by Medicare and many private medical insurance plans. Please consult with your health insurance supplier to obtain the necessary health/medical coverage for overseas travel.

STATE DEPARTMENT/GOVERNMENT AGENCIES: It is essential to prepare for a safe and healthy travel abroad. Therefore, before you travel, we strongly recommend that you visit the website of the U.S. Department of State at https://travel.state.gov/content/travel.html for up-to-date travel advice on countries that you are visiting. On occasion, a U.S. or foreign government agency, such as the U.S. Department of State (www.state.gov), Center for Disease Control (www.cdc.gov), etc., may issue a travel advisory, warning or alert for a destination or surrounding area you may be visiting while on tour. NAWAS encourages you to refer to these agencies to obtain the most current and up-to-date information. These Terms and Conditions, including cancellation policies, cannot be altered based on any occurrence whatsoever and/or any travel advisory, warning or alert or other government restrictions issued in the U.S. or foreign countries or by governing bodies/agencies where your tour is scheduled to visit, including but not limited to war/terrorism or the threat thereof, political upheaval, disease, sickness, illness, epidemics or the threat thereof, pandemics, quarantine restrictions, natural disasters, or any other circumstances or factors. Cancellation penalties remain in full effect and no exceptions can be made. You accept the risks involved in travel, both foreign and domestic, and accept responsibility for your own travel decisions. Should a travel warning or advisory be issued on a region or country that you are visiting, either prior to departure or during your trip, NAWAS will not be liable for damages or losses that result from travel to such destinations. Please remember that you have the same responsibility for your personal safety and possessions as you do at home.

GENERAL DISCLAIMER/RESPONSIBILITY

RELEASE FROM LIABILITY: NAWAS INTERNATIONAL TRAVEL SERVICE, INC., its affiliates including but not limited to, Nawas Tourist Agency, LTD and Nawas Tourist Co., and its and their employees, agents, shareholders, directors, officers, successors, and assigns, and Tour Leaders (collectively “The Released Parties”) do not own or operate any entity which is to or does provide goods or services for your trip. The Released Parties purchase transportation (by aircraft, coach, train, vessel, or otherwise), hotel and other lodging accommodations, meals, restaurants, ground handling, tour director and guide services, and other services from various independent suppliers (including from time-to-time other affiliated NAWAS companies). All such persons and entities are independent contractors. Independent contractors may utilize the NAWAS logo on signage or uniforms for identification purposes which does not signify NAWAS ownership, management, or control. As a result, the Released Parties are not liable for any negligent or willful act or failure to act of any such person or entity, or of any third party. The Released Parties act only in the capacity of agents in all matters pertaining to air transportation, hotel accommodations, sightseeing tours and transportation, whether by railroad, motor bus, motorcoach, motor car, cruise vessel, boat, air, or any other means. Without limitation, the Released Parties are not liable for any damage, loss (including but not limited to personal injury, loss of enjoyment, distress, death and property loss), expense or inconvenience caused by any act or omission of any supplier providing tour services or by any other person or reason whatsoever, including its own negligence, or by any delays or changes in the itinerary, or the acts and omissions of the tour leader/host or travel agent. The Release Parties assume no liability or responsibility for any injuries, inconveniences, illness, irregularity or incidental damages occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, circumstances beyond the control of The Released Parties, strikes or other labor activities, revolts, riots, political upheaval, wars, political rhetoric made by anyone that may have a real effect or psychological effect on the perception of a destination that you may be visiting, criminal or terrorist activity or the threat thereof, nuclear events, environmental pollution or contamination, water or power shortages, diseases, diseases and dangers associated with or bites from animals, pests, or insects, marine life or vegetation of any sort, or through human contact/interaction, pandemics, epidemics or the threat thereof, natural disasters, weather, wet conditions, closures of airports, closures of hotels, closures of included sites, overbooking or downgrading of accommodations, denial of boarding, event cancellations, event postponements, supplier bankruptcy, default or insolvency, default of a supplier in providing the agreed upon transportation or service, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers incident to recreational activities such as swimming, walking, sailing, boating, hot air-ballooning, riding of a camel, horse, or any other animal, or bicycling amongst others, sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, default or omission of any common or private carrier, or any other cause beyond the direct control of the Released Parties. In addition, you, your estate and heirs, legal representatives and assigns release the Released Parties from their own negligence and assume all risk thereof.

Guest shall indemnify and hold harmless Nawas International Travel Service, Inc., its affiliates and its and their employees, agents, shareholders, directors, officers, successors, and assigns and tour leaders, hosts or organizers (collectively “The Released Parties”), from all suits, actions, losses, damages, claims or liability for any personal injury, death, property damage or other loss, accident, delay, inconvenience or irregularity which is occasioned by any negligent acts or omissions of The Released Parties arising out of any goods or services provided for this or these trips.

Payment of the deposit to NAWAS constitutes acceptance of these terms and conditions for yourself and all members or your party or group.

The airlines concerned are not to be held responsible for any act, omission or event during the time passengers are not on board their plane or conveyance. The passage contract in use by the airlines concerned, when issued, shall constitute the sole contract between the airlines and the guest.

NAWAS may take photographs or video/audio recordings of its trips and guests, and you grant NAWAS express permission to do so and for NAWAS to use such for promotional or commercial use without payment of any fee or royalties. In addition, any comments that you submit as a review or your social media posts may be used for the promotional and commercial purposes of NAWAS.

ADDITIONAL RISKS: Additional risks and dangers may arise including, but not limited to, hazards of travel by train, automobile, vehicle motorized or otherwise, motor coach, aircraft, cruise ships, boats, water vessels, and any other means of conveyance, animal interactions, human interactions, forces of nature, political unrest, other unrest, risks associated with water, food, plants, insects and differing animal regulation, and acts of national and local governments and unrest and acts of others against governments, event cancellations, event postponements, and supplier bankruptcy, default or insolvency. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are risks involved, and you hereby agree to accept any and all risks.

You understand the physical requirements of the activity in which you will be participating, and you currently have no known physical, medical or mental condition which would impair your ability to participate in this tour or your safety in this activity, and you are willing to assume all risks that may be created, directly or indirectly, by any such condition. As lawful consideration for the agreement with NAWAS and the tour leaders, hosts and organizers to participate in such trips and activities you agree you will not make a claim against NAWAS, its related companies or its personnel and the tour leaders, hosts and organizers or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release NAWAS, its related companies and its personnel and the tour leaders, hosts and organizers from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your Estate and heirs, legal representatives and assigns and this provision shall be enforceable even after your trip has ended.

NAWAS is not responsible, and will not be bound by, representations made by third party representatives, Tour Leaders, tour directors, other guests registered on the tour, travel agents, unaffiliated websites, unaffiliated documents, or any other party. NAWAS is not responsible and will not be bound by promises (written or verbal) made by local hotel staff, tour guides, tour directors, Tour Leaders, travel agents, or any other persons not under direct employment of NAWAS.

CHANGES TO THE TOUR: Without limitation, NAWAS reserves the right to cancel, advance, postpone or modify the tour that you have booked, including, departure or return dates, as well as locations, events and schedules, and may, but is not obligated to substitute, vary, alter, reschedule, cancel and/or relocate any accommodations, modes of transportation and other aspects of the tour. Additionally, NAWAS reserves the right to make changes to the tour, including deleting, adding, or substituting overnight locations and/or visited locations, substituting Tour Leaders or operating the tour without a Tour Leader, duration of itinerary, itinerary sequence, included sites, accommodations, including upgrading or downgrading of accommodation quality, event inclusions, meals, transportation modes, tour guides and included guide services. NAWAS is authorized to take these actions due to causes or circumstances of any kind or nature beyond the control of NAWAS, or causes or circumstances within the control of NAWAS that NAWAS deems to make such actions appropriate. NAWAS will not be liable for cancellation, delay, rescheduling or other adjustment or impact to a departure or itinerary, or other aspects of the tour.

TOUR LEADERS: Tour Leaders are tour leaders, hosts, organizers, and other entities involved in the sponsorship, hosting, and/or promotion of the tour and are wholly independent and are not employees or agents of NAWAS INTERNATIONAL TRAVEL SERVICE, INC., its affiliates and its and their employees, agents, shareholders, directors, officers, successors, and assigns (collectively “NAWAS”). NAWAS’ engagement for a Tour Leader’s services is not to be considered an endorsement. When booking with a Tour Leader your agreement is directly with NAWAS and not the Tour Leader and you are subject to these Terms and Conditions, including the Jurisdiction/Choice of Law/Venue policy of these Terms and Conditions.

CHANGES TO THE TERMS AND CONDITIONS: You acknowledge and agree that NAWAS may change these Terms and Conditions from time to time and that those changes become effective immediately. If we make material changes, we will provide you notice. Your continued use of our services following the notice of any material changes constitutes your acceptance and agreement to be bound by such changes. You agree to be bound by the Terms and Conditions that are in effect at the time of travel or cancellation.

COVID 19 RELEASE OF LIABILITY: Guest expressly acknowledges that naturally occurring diseases and viruses (including, but not limited to, the currently widespread COVID-19) may be present and actively occurring in all environments in which your tour will take place as well as other places where the tour takes place such as airports, airplanes, terminals, hotels, restaurants, museums, motor coaches, cars, trains, cruise vessels, boats, ferries and the like. You acknowledge the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. You acknowledge that COVID-19 has made travel uncertain due to government closures and other travel restrictions. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact (however the exact method of spread remains unknown). You also understand that if you are older or have underlying conditions, you may be more prone to serious infection and death due to COVID-19. As a result of the highly infectious nature of this disease, federal, state, and local governments health agencies recommend social distancing, wearing of Personal Protective Equipment “PPE” (including masks), and have, in many locations, prohibited the congregation of groups of people. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, that cannot be controlled or eliminated by NAWAS and the tour leaders, hosts and organizers.

By booking a trip at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your trip.

You acknowledge that due to the uncertainty of travel at this time, your trip may be postponed or cancelled or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine upon arrival in some locations. You understand that you may become sick before, during, or after the trip and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable.

You agree that due to uncertainty caused by COVID 19, NAWAS has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage if and when available. NAWAS shall not be liable for any losses howsoever arising.

You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS NAWAS INTERNATIONAL TRAVEL SERVICE, Inc., its members. officers, agents, and/or employees, suppliers, Tour Leaders, and other tour members (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, to the fullest extent permitted by law. The terms of this INDEMNIFICATION, HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

HEALTH: For the safety of our guests, NAWAS reserves the right to request health information prior to travel and to exclude any participants it deems unfit for travel at its sole discretion. It is essential that you see your health care provider before booking your trip and before traveling to make sure that you have taken all necessary health precautions. For up-to-date medical advice we strongly recommend that you visit the Centers for Disease Control and Prevention (CDC) travelers’ health page: www.cdc.gov/travel or for non-US citizens, your country’s equivalent.

It is your sole responsibility to secure in a timely manner and/or pay for any and all immunizations, vaccinations, tests, screenings, and health standards that are required to be permitted to fly and for entry into each country or destination. Certain countries have or may have a requirement for foreign visitors to have valid medical insurance and proof of immunization and vaccination on entry. Additionally, Governments may require guests to submit to tracking for health purposes. NAWAS is not responsible or liable in the event that governments impose procedures or restrictions and you fail to comply with these and it is your responsibility to be aware of and comply with the requirements of the destination that you will be traveling to. Failure to submit to governmental requirements with regard to health and safety may result in the guest being denied entry. In such case NAWAS will have no responsibility whatever and will make no refund.

Required inoculations/vaccinations, screenings, or tests, if any, must be recorded by client’s health practitioner on a valid vaccination/screening/test certificate which the client must carry for proof of inoculation/vaccination/screening/test where required. Any person who arrives to the destination ill with apparent fever or becomes ill during the tour may be required to be removed from the group and directed to a local medical facility for diagnosis. Only upon written clearance from an accredited medical facility that the guest is able to continue participating in the remaining activities of the tour will that guest be allowed to resume group travel. All costs associated with medical treatment and related expenses such as additional hotel nights the purchase of new airline tickets, or transportation not included in the original itinerary will be the responsibility of the guest.

In the event that proof of a vaccination (of any type) or health screenings or testing of any nature is required to travel by airlines, public or private transportation, cruise vessels, hotels, restaurants or touring sites, by governmental entities or any tour related entity, it is understood that it is the sole responsibility of the guest to facilitate the acquisition of the vaccination(s), screenings, or tests and to carry proof of vaccination, screening or test. Costs for vaccination(s), screening or tests or other related logistics are totally at the additional expense and responsibility of the guest. If, after a guest has made payments for a tour but subsequently elects not to receive a vaccination(s), screening or tests, or for any reason is unable to receive a vaccination or screening or test in a time-frame that allows them to travel on the scheduled departure dates, regardless of the reason, or if the guest tests positively or is required to quarantine, the terms and conditions including the cancellation policies apply and are not altered.

ERRORS AND OMISSIONS: While every effort is made to ensure the accuracy of information in our brochures, on our website, on documents, including, but not limited to, your final travel documents, itinerary, flight schedules or invoice for payment, or communicated by our staff, errors or omissions are possible and NAWAS is not responsible for such error. If a mistake is made in billing, we reserve the right to correct the invoice and you will be responsible for proper payment.

YOUR CONDUCT AND INDEMNIFICATION: Each guest is expected to act responsibly and adhere to all behavior guidelines established by NAWAS, the Tour Leaders, and our local suppliers. We, the Tour Leaders, and our local suppliers reserve the right to remove you from any trip if you endanger yourself or others or disrupt the general well-being of the trip itself. In any such case, there will be no refund.

When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us and the Tour Leaders. NAWAS and the Tour Leaders are not responsible for any costs incurred concerning a guest removed from a tour. Baggage and personal effects are at all times the sole responsibility of the guest.

RIGHT TO ACCEPT OR REJECT: NAWAS reserves the right to accept or reject any person as a guest prior to departure for any reason or no reason at all. In the event of rejection of participation prior to departure, the only responsibility of NAWAS is to provide you with a full refund of all monies paid for the reservation, excluding any non-recoverable costs.

ENGLISH LANGUAGE: This agreement shall be written in, and all other communication under or in connection with this Agreement shall be in, the English Language. Any translation into any other language shall not be an official version thereof, and in the event of any conflict in the interpretation between the English version and such translation, the English version shall control.

CA Seller of Travel: Nawas International Travel Service, Inc. is a registered seller of travel in the State of California, CST #1005405-40, and is a participant in the Travel Consumer Restitution Fund. Registration as a seller of travel does not constitute approval by the State of California. California law requires certain sellers of travel to have a trust account or bond. Nawas International Travel Service, Inc has a trust account.

CA Disclosure: Upon cancellation of the tour or travel arrangement, if a guest cancels their tour or travel arrangement in compliance with the Terms and Conditions of Nawas International Travel Service, Inc. including the cancellation policies of NAWAS and NAWAS’ suppliers, and is not at fault, then sums paid to NAWAS for services not provided (less the applicable deductions provided for in the cancellation policies) will be promptly refunded in accordance with our Terms and Conditions, unless the guest otherwise advises NAWAS in writing, after cancellation. This provision does not apply where Nawas has remitted the payment to another wholesale seller of travel or a carrier or cruise line without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon-transportation or service. In this situation, we will upon request provide the passenger with records detailing the status of their payments, and if disbursed to a registered wholesale seller of travel, proof of current registration of that wholesaler.

Purchasers within CA: This transaction is covered by the California Travel Consumer Restitution Fund (TCRF) if the seller of travel was registered and participating in the TCRF at the time of sale and the passenger is located in California at the time of payment. Nawas International Travel Service, Inc is currently a registered participant in the TCRF. Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove your claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a TCRF claim. Guests purchasing from Nawas International Travel Service, Inc. from outside California are not covered by the California Travel Consumer Restitution Fund.

SEVERABILITY: If any provision of these terms and conditions shall be held unenforceable, such provision shall be struck and the remainder shall remain enforceable.

JURISDICTION/CHOICE OF LAW/VENUE: EXCLUSIVE JURISDICTION AND VENUE FOR ANY AND ALL DISPUTES ARISING UNDER, IN CONNECTION WITH, OR RELATED TO THESE TERMS AND CONDITIONS OR THE PROVISION OF SERVICES BY NAWAS INTERNATIONAL TRAVEL SERVICE, INC. SHALL BE IN THE STATE COURT SITTING IN FAIRFIELD COUNTY, CONNECTICUT, AND YOU EXPRESSLY AGREE NOT TO CHALLENGE THE JURISDICTION OR VENUE OF SUCH COURT OR TO ASSERT THAT SUCH COURT IS NOT A CONVENIENT FORUM. ALL DISPUTES ARISING UNDER, IN CONNECTION WITH, OR RELATED TO THESE TERMS AND CONDITIONS OR THE PROVISION OF SERVICES BY NAWAS INTERNATIONAL TRAVEL SERVICE, INC. SHALL BE GOVERNED BY THE INTERNAL LAWS OF THE STATE OF CONNECTICUT, WITHOUT REGARD TO ITS CONFLICTS OF LAW PROVISIONS. PAYMENT OF DEPOSIT BY GUEST INDICATES ACCEPTANCE OF THESE TERMS AND CONDITIONS FOR YOURSELF AND ALL MEMBERS OR YOUR PARTY OR GROUP.

DISPUTES/CLASS ACTION WAIVER: YOU AGREE THAT YOU WILL ONLY BRING CLAIMS AGAINST NAWAS IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU AGREE THAT CLASS ACTION LAWSUITS, CLASS-WIDE ARBITRATIONS AND ANY OTHER PROCEEDING WHERE SOMEONE ACTS IN A REPRESENTATIVE CAPACITY ARE HEREBY WAIVED AND DISALLOWED. ADDITIONALLY, NO PROCEEDINGS SHALL BE COMBINED WITHOUT THE CONSENT OF ALL PARTIES. NAWAS SHALL NOT IN ANY CASE BE LIABLE FOR OTHER THAN COMPENSATORY DAMAGES, AND YOUR PAYMENT OF A DEPOSIT ON A TOUR MEANS THAT YOU AGREE TO THESE CONDITIONS OF SALE FOR YOURSELF AND ALL MEMBERS OR YOUR PARTY OR GROUP AND EXPRESSLY WAIVE ANY RIGHT TO PUNITIVE DAMAGES.

CLAIMS: YOU UNDERSTAND AND AGREE THAT NO CLAIMS WILL BE CONSIDERED AND THAT YOU WILL NOT BRING SUIT AGAINST NAWAS INTERNATIONAL TRAVEL SERVICE, INC. UNLESS YOU HAVE FIRST PROVIDED A TYPEWRITTEN NOTICE OF CLAIM TO NAWAS INTERNATIONAL TRAVEL SERVICE, INC. WITHIN 30 DAYS AFTER THE TOUR OR CANCELLATION OF THE TOUR.

ATTORNEY’S FEES AND COSTS: If either party brings an Action to enforce their rights under this agreement, the prevailing party may recover its expenses (including reasonable attorneys’ fees) incurred in connection with the Action and any appeal from the losing party.

VOLUNTARY PARTICIPATION: You certify that you have willingly and of your own volition applied to participate as a guest on the tour or travel arrangement and that you have read the description of the tour as it appears in the tour’s brochure together with all information contained in the reservation form and these Terms and Conditions. You are willingly and of your own volition participating in this trip with the knowledge and complete understanding of these Terms and Conditions and the cancellation policies, Force Majeure, Release from Liability, Additional Risks, Changes to the Tour, Covid-19 Release of Liability, Health, Severability, Jurisdiction/Choice of Law/Venue, Disputes/Class Action Waiver, Claims, and all of the risks, dangers, and hazards involved.

KNOWING AND VOLUNTARY AGREEMENT: YOU CERTIFY THAT YOU ARE AT LEAST 18 YEARS OF AGE AND THAT YOU HAVE THOROUGHLY READ THE ENTIRETY OF THESE TERMS AND CONDITIONS AND YOUR TOUR’S BROCHURE AND RESERVATION FORM IN THEIR ENTIRETY AND YOU ACKNOWLEDGE THAT YOU HAVE A COMPLETE UNDERSTANDING OF THE CONTENTS OF THE TERMS AND CONDITIONS AND YOUR TOUR’S BROCHURE AND RESERVATION FORM. YOU CERTIFY THAT YOU ARE FULLY AWARE THAT THIS IS CONTRACT AND A RELEASE OF LIABILITY BETWEEN YOURSELF AND NAWAS INTERNATIONAL TRAVEL SERVICE, INC. AND YOU AGREE OF YOUR OWN FREE WILL TO ALL OF THE TERMS AND CONDITIONS OF THIS CONTRACT AND RELEASE FROM LIABILITY. BY PAYMENT OF DEPOSIT, YOU, FOR YOURSELF AND ALL MEMBERS OF YOUR TRAVELING PARTY, AGREE TO THESE TRAVEL TERMS AND CONDITIONS AND THE CANCELLATION POLICIES, FORCE MAJEURE, RELEASE FROM LIABILITY, ADDITIONAL RISKS, CHANGES TO THE TOUR, COVID-19 RELEASE OF LIABILITY, HEALTH, SEVERABILITY, JURISDICTION/CHOICE OF LAW/VENUE, DISPUTES/CLASS ACTION WAIVER, AND CLAIMS FOR YOURSELF, EACH MEMBER OF YOUR TRAVELING PARTY AND ANY MINOR CHILDREN ACCOMPANYING YOU.
